Terms of sale

This page says what you are buying, who you are buying it from, and how to get your money back. The site is a joke. The payment is real, so this page is not one. In these terms, “we”, “us” and “our” mean Daring Spirit Oy, and “you” means the person paying.

Write to that address for anything at all: refunds, complaints, removing your name, or telling us the idea was bad. We answer.

What you are buying

One block on the clock shown on this site. A block is currently 15 minutes long and costs US$5. The length and the price are shown before you pay, and both can change; whatever is on screen at the moment of payment is what applies to your purchase.

Paying does two things, and only these two:

• it marks that block on the public clock;
• it labels the block with the name you type at checkout, or leaves it unlabelled if you type nothing.

That is the entire product. It is bought for amusement, not for any practical result.

No promise, no guarantee

The site is written as a joke. To be unambiguous about what that means for a purchase:

• Nothing on this site or in this document obliges us to do, or to refrain from doing, anything at any time.
• No result, behaviour or outcome of any kind is promised, undertaken, warranted or guaranteed to you.
• The clock, the wording around it and the figures on it are part of the joke and are not statements of fact you should rely on.

What you buy is the block on the clock. Nothing else is sold, owed or implied. If that is not an acceptable basis for spending five dollars, please do not spend it.

What you are not buying

• No software, licence, account, subscription or download.
• No goods, and nothing that will be shipped to you.
• No service performed for you beyond the block on the clock.
• No rights in anything else we do or make.
• No advice of any kind, and nothing you should rely on for any decision.

Your right to change your mind

Because a block is a service that starts as soon as it is bought, at checkout you are asked to expressly request that performance begin immediately and to acknowledge that you lose your right of withdrawal once the block has been fully performed. This is what the checkbox on the payment page means.

In practice: you may cancel and get a full refund at any time until the block you bought has elapsed. Once it has passed, the service has been performed in full and the statutory right of withdrawal no longer applies. Blocks bought for a future time can be cancelled right up until they start.

Refunds

Beyond the above, we refund on request in any of these cases, and generally whenever asking feels reasonable:

• You changed your mind.
• You paid twice, or paid by mistake.
• You want your name off the site and would rather have the money.
• You expected something other than a block on the clock.

Refunds go back to the card you paid with, through Stripe, and normally arrive within five to ten business days.

Your name on the site

The name field at checkout is optional and free text. Whatever you type is shown publicly on the site next to the block you bought, together with the country your payment came from. If you leave it empty the block is shown without a name.

Do not enter anyone else's name, personal data, contact details or anything unlawful, abusive or infringing. We remove anything like that without notice, and we may refuse and refund a purchase on that basis alone. To have your name taken down, write to the address above.

The site itself

The site is provided as it is and as it happens to be available. We may change it, pause it, break it, empty the clock or take the whole thing down at any moment, without notice and without owing anyone anything. Nothing here guarantees that a block you bought will remain visible, or that the site will exist tomorrow.

Payment and data

Payments are handled by Stripe. We never see or store your card details. From a purchase we receive your email address, the country of the card, the amount, and the name you chose to enter. We use those to run the site, to answer you, and to meet accounting obligations.

The site also uses Google Analytics to count visits. Nothing on the site is sold or passed on for advertising.

Liability

To the extent the law allows, our total liability to you for anything connected with a purchase is limited to the amount you paid for it. Nothing here limits liability that cannot be limited by law, including liability for death, personal injury, fraud, or your mandatory rights as a consumer.

Changes

We may change these terms. The version in force for your purchase is the one published at the moment you paid, and the date at the top of this page tells you when it last changed.

Law and disputes

These terms are governed by Finnish law, and disputes are heard by the District Court of Helsinki. If you are a consumer resident in the European Union, this does not deprive you of the protection of the mandatory rules of your own country, and you may also bring a claim in the courts there.

Consumers in the EU may use the European Commission's online dispute resolution platform, and consumers in Finland may contact the Consumer Disputes Board. Before any of that, please just email us.
